Your access to and use of Factech's services like web portal, mobile App(s), API(s), etc hereinafter "Factech" is subject exclusively to these Terms and Conditions. You will not use the Factech for any purpose that is unlawful or prohibited by these Terms and Conditions. By using the Factech you are fully accepting the terms, conditions and disclaimers contained in this notice. If you do not accept these Terms and Conditions you must immediately stop using the Factech.
You are responsible for maintaining the confidentiality of the User Id and password you choose and are fully responsible for all activities that occur under your account. You agree to immediately notify Factech Automation Solutions Pvt. Ltd. of any unauthorized use of your password. Factech Automation Solutions Pvt. Ltd. will not be liable for any consequence arising from your failure to comply with this Section.
Factech reserves the right to change or remove (temporarily or permanently) the Factech or any part of it without notice and you confirm that Factech shall not be liable to you for any such change or removal.
Any change to these Terms and Conditions shall be notified in advance to the users, and your continued use of the Factech following any changes notified to you shall be deemed to be your acceptance of such change. Additionally, Factech
will undergo continuous modifications in its Features and Services.Users shall have prior notice of any such changes and updates through a popup when they log into the system
Factech may include links to third party websites that are controlled and maintained by others. Any link to other websites is not an endorsement of such websites and you acknowledge and agree that we are not responsible for the content or availability of any such sites.
You understand that all information (such as data files, written text, audio files, images or any other media) which you may have access to as part of, or through your use of Factech are the sole responsibility of the person from which such content originated. Factech Automation Solutions Pvt. Ltd. takes no responsibility for abusive content, and it is the responsibility of the users to regulate such content. Factech Automation Solutions Pvt. Ltd. takes no responsibility for any data generated within Factech and published or distributed outside by the user. Factech Automation Solutions Pvt. Ltd. reserves the right to suspend its service to users involving in service abuse.
You agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any portion of the service, use of the Service, or access to the Service. Factech reserves the right at any time to modify or discontinue, temporarily or permanently, the Service (or any part thereof). This will take place with notice and adequate time given to you, so that you may retain the information assets created by you on Factech. Beyond the time given, you agree that Factech shall not be liable to you or to any third party.
You acknowledge and agree that the Service contains proprietary and confidential information that is protected by applicable intellectual property and other laws. Except as expressly authorized by Factech, you agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on the Service, in whole or in part. You also agree not to extract the code or reverse-engineer it in anyway. Any attempt at hacking or unlawful use of Factech can and will invite the maximum prosecution allowable under the law.
Factech acknowledges and agrees that any information provided by you shall remain your proprietary information. Factech shall not sell or rent or commercially exploit in any manner any information provided by you to third parties for any reason.
The Factech is provided on an AS IS and AS AVAILABLE basis without any representation or endorsement made and without warranty of any kind whether express or implied, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.
To the extent permitted by law, Factech will not be liable for any indirect or consequential loss or damage whatever (including without limitation loss of business, opportunity, data, profits) arising out of or in connection with the use of the Factech. It makes no warranty that the functionality of the Factech will be uninterrupted or error free, that defects will be corrected or that the Factech or the server that makes it available are free of viruses or anything else which may be harmful or destructive. Nothing in these Terms and Conditions shall be construed so as to exclude or limit the liability of Factech for death or personal injury as a result of the negligence of Factech or that of its employees or agents.
You agree to indemnify and hold Factech and its employees and agents harmless from and against all liabilities, legal fees, damages, losses, costs and other expenses in relation to any claims or actions brought against Factech arising directly out of any breach by you of these Terms and Conditions.
If any of these Terms and Conditions should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction then such Term or Condition shall be severed and the remaining Terms and Conditions shall survive and remain in full force and effect and continue to be binding and enforceable.
